TEWA APP User Agreement

    Welcome to use TEWA Moto products and TEWA APP.

    This agreement is concluded between you and TEWA MOTO INC for the registration and use of the TEWA account. TEWA MOTO INC. (hereinafter referred to as "TEWA") hereby reminds you in particular Carefully read and fully understand the terms of this agreement, the terms exempting or limiting TEWA's liability, the terms limiting your rights, dispute resolution, and applicable laws, etc. Please read it carefully and choose to accept or not accept this agreement (a person with limited civil capacity should read it with a guardian or legal representative). Unless you accept all the terms of this agreement, you have no right to register and use an TEWA account. Your registration and use of the TEWA account will be deemed that you have fully understood this agreement (that is, this agreement and subsequent updated versions or a single agreement for opening or using a certain service), and agree to be bound by the terms of this agreement.

About TEWA Account

    The TEWA account is an identifier owned by TEWA used to identify you. The ownership of the account belongs to TEWA. As the initial registrant, you only have the right to use the account you registered.

Account usage rules

    1. Register an account

    You should provide timely, detailed, and accurate personal information, and constantly update the registration information to meet the timely, detailed, and accurate requirements. You guarantee that all the information submitted during registration (including but not limited to the mobile phone number, email address, etc.) is true, accurate, legal, valid, and is your information. If the registration information is untrue or not updated in time, TEWA will not be responsible for any related problems. You can inquire and correct your information through the account settings page of TEWA. The registered information such as the account name, avatar, and profile submitted by you shall not contain illegal or undesirable information. After verification by TEWA, TEWA will not register if the above conditions exist. ; At the same time, after registration, if it is found that you have fraudulently obtained the account name registered with false information, or your account picture, profile and other registration information contains illegal and undesirable information, TEWA has the right to take corrective action, suspend use, Measures such as account termination. After you fill in the information as prompted on the registration page, read and agree to the terms of this agreement, and complete all registration procedures, you can obtain an TEWA account and become an TEWA APP user

    2. Account usage

    2.1 You are responsible for all the results of actions under your account (including but not limited to the online signing of various individual terms, posting information, purchasing goods and services, and disclosing information, etc.).

    2.2 If you choose a third-party account to log in to TEWA services, the third-party account will be associated with your TEWA account, and TEWA will use your information (such as an avatar) based on the information provided by the third party authorized by you. Your subsequent use of the TEWA account is governed by this agreement.

    3. Account Keeping and Retrieval

    3.1 The TEWA account includes the account name and password. You can log in with the account name (including the account ID, mobile phone number, and email address) and password set. You should keep your account and password properly, and change the password regularly for your reasons. If the account information is lost due to the loss, if you need to retrieve the TEWA account information, please provide the corresponding information according to the TEWA account retrieval process, and ensure that the information provided is legal, true, and valid. If the information provided does not meet the requirements, you cannot pass TEWA Security For verification, TEWA reserves the right to refuse to provide account recovery services;

    3.2 If the TEWA account you are currently using is not the one you initially applied for registration or obtained through other means provided by TEWA, but you know the current password of the TEWA account, you may not use the TEWA account to log in or perform any operations. , And please notify TEWA or the person who initially applied for the account of TEWA as soon as possible.

    4. Account transfer

    4.1 You can use the TEWA account within the scope agreed in this agreement. You must not maliciously register the TEWA account, and you may not gift, borrow, rent, transfer or sell the TEWA account with compensation or free of charge, or otherwise permit non-initial registrants to use it. For the TEWA account, TEWA has the right to independently judge and deal with the above-mentioned behaviors. You should bear any responsibilities arising therefrom, and TEWA reserves the right to pursue the legal liabilities of the above-mentioned actors. And all the responsibilities arising therefrom shall be borne by you.

    4.2 TEWA has the right to take the following measures against you under laws and regulations:

    4.2.1 If you violate the laws, regulations, individual clauses, or business rules of TEWA, TEWA has the right to make independent judgments and take corrective action, suspend use, or terminate your use of TEWA account at any time, and make decisions based on actual conditions. Whether to resume use.

    4.2.2 If TEWA finds that you are not the person who initially applied for the account, TEWA has the right to terminate your use of the account without notice.

    4.2.3 Under these rules or relevant laws and regulations, TEWA corrects, suspends the use or terminates your use of TEWA account within a time limit, and the losses caused to you (including but not limited to communication interruption, user information, emails, and Clearing of relevant data, etc.) is your responsibility.

    5. Account Security

    5.1 Your account is set up for you and kept by you. TEWA will not actively ask you to provide your account password at any time. It is recommended that you take specific measures to protect the security of your account, including but not limited to installing anti-virus Trojan software, and regularly changing passwords.

    5.2 TEWA account is not liable for the losses and consequences caused by your active disclosure or attack or fraud by others. You should seek compensation from the infringer through judicial, administrative, and other remedies.

    6. Account cancellation

    6.1 When it is necessary to terminate the use of the TEWA account service, you can apply to cancel your TEWA account if the following conditions are met.

    6.1.1 You can only apply for cancellation of your account, and follow the procedures of TEWA to cancel;

    6.1.2 You should still be responsible for your actions before you cancel your account and during the use of TEWA services.

    6.1.3 You should be aware that the termination of your account means that your user content will be deleted from our activity database or related information will be anonymized.

User rights and obligations

    When you use TEWA's services, you must abide by the relevant laws and regulations of USA, and the regulations of Country of your location. You should agree that you will not use this service for any illegal or improper activities, including but not limited to the following:

    Upload, display, post, disseminate, or otherwise transmit information containing one of the following:

    • 1.1.1 Oppose the basic principles established by the Constitution;

    • 1.1.2 Endangering national security, leaking state secrets, subverting state power, and undermining national unity;

    • 1.1.3 Damage to national honor and interests;

    • 1.1.4 Inciting ethnic hatred, ethnic discrimination, or undermining ethnic unity;

    • 1.1.5 Undermine national religious policies and promote cults and feudal superstitions;

    • 1.1.6 Spread rumors, disrupt social order, and undermine social stability;

    • 1.1.7 Spread obscenity, pornography, gambling, violence, murder, terror or instigate crime;

    • 1.1.8 Insulting or slandering others, infringing on the legal rights of others;

    • 1.1.9 contains false, harmful, intimidating, infringing on the privacy of others, harassment, infringement, slander, vulgar, obscene, or other morally offensive content;

    • 1.1.10 Contains other content restricted or prohibited by USA laws, regulations, rules, regulations and any norms with legal effect;

    If you violate this agreement or the relevant terms of service, you have caused or caused any third party claims, demands, or losses, including reasonable attorney's fees, from TEWA and cooperative companies, affiliated companies, and you agree to compensate TEWA and Cooperation Companies, affiliates, and protect them from damage. At the same time, TEWA has the right to take measures including, but not limited to, deleting the content of the published information, suspending the use license, terminating the service, restricting the use of TEWA's account, and investigating legal liabilities, depending on the nature of your behavior. At the same time, TEWA will assist in the investigation according to the request of the judicial department.

    You shall bear legal responsibility for your actions in the process of using TEWA's services. The forms of your legal liability include, but are not limited to: compensation for the infringed, and after TEWA first assumes the administrative penalty or tort damages liability caused by your actions, you should give TEWA an equal amount of compensation.

    Under any circumstance, TEWA will not be liable for any indirect, consequential, punitive, incidental, special, or punitive damages arising from this agreement by you or any third party.

Intellectual-property

    1. You can use the TEWA APP to publish your original works, opinions, and opinions, or publish data, text, information, signatures, photos, personal information, audio, video, links, and other information content. You should ensure that the ownership of the information you upload and all intellectual property rights are owned by you or have been legally authorized. Any use of software and services will not constitute an infringement of the legal rights of any third party. If any third party raises an objection or complaint to the copyright, TEWA World has the right to delete any data or content and has the right to pursue your relevant legal responsibilities. For the related losses (whether intentional or negligent) caused by your actions, you should compensate and bear the legal responsibility for the injured party.

    2. The copyright of all original content (including but not limited to text, pictures, and videos) published by you belongs to you. You can grant or authorize your original content to any third party in any form, without the consent of TEWA.

    3. When you use our services or share, publish or upload any intellectual property-protected content related to our services, you will be deemed to have granted TEWA a non-exclusive, royalty-free, irrevocable, transferable, and Sub-licenses and licenses for worldwide use. According to this license, TEWA World is authorized to use such content in any product, service, and promotion in any form, including but not limited to websites, published applications, or other Internet products or social media application.

Disclaimer

    TEWA will not assume any legal responsibility if the following situations occur:

    1. Provide your personal information under laws and regulations or the requirements of relevant government departments;

    2. The disclosure of any personal information due to your improper use or other reasons of your own;

    3. Any service interruption or obstruction caused by hacker attacks, computer virus intrusion, illegal content information, harassing information, government control, and any other reasons such as network, technology, communication lines, information security management measures, etc. cannot meet your requirements Situation

    4. Due to a third party such as an operator's communication line failure, technical problems, network, computer failure, system instability, and other losses caused by force majeure;

    6. Any psychological, physical harm, and economic loss caused or possibly caused by the user's interactions with other users through this APP, program, and service due to misleading or deception;

    7. TEWA's services expressly declare that it does not guarantee the timeliness, safety, and accuracy of the services of TEWA and its partner companies in any form, expressly, impliedly, or in any form.

    8. Any content posted by you using the TEWA account does not represent and reflect any views or policies of TEWA, and TEWA does not assume any responsibility for this.

    9. Under any circumstances, TEWA will not be liable for any indirect, consequential, punitive, incidental, special, or penal damages, including the loss of profits suffered by you due to your use of TEWA's services. Although there may be contradictory provisions in this agreement, our full responsibility to you, regardless of the reason or behavior, will never exceed the fees (if any ).

    10. You can choose to use your existing third-party account to associate your TEWA account. TEWA will not be liable for any losses caused to you due to third-party reasons.

Revision

    Because of the rapid development of Internet-related technologies, markets, business models, etc., you agree that TEWA has the right to make and modify from time to time under changes in relevant laws and regulations, the development of the Internet, and the adjustment of the company's operating conditions and business strategies. This agreement and various rules. If there is any amendment, TEWA will notify it through statutory procedures. Once the revised agreement and rules are announced, they will automatically take effect immediately and become an integral part of this service agreement. If you do not agree to the above amendments, you must immediately stop using the services under this agreement. If you continue to log in or continue to use the TEWA service, it means that you approve and accept the revised agreement and rules.

Termination

    1. This agreement will be effective from the date you accept it and will continue to be effective during your use of TEWA's services until terminated under this agreement;

    2. Notwithstanding the above provisions, if you use the TEWA service earlier than the time you accept this agreement, you hereby know or should know and agree that this agreement will take effect the first time you use the TEWA service, unless under this agreement. The agreement was terminated early.

    3. We may reserve your right to use TEWA services or TEWA account under the provisions of the law; whether notified or not, we will terminate this agreement at any time for any reason, including believing in good faith that you have violated our Acceptable use policy or other provisions of this agreement.

    4. Not limited by the provisions of the preceding paragraph, if you infringe the copyright of a third party and TEWA receives notice from the copyright owner or the legal agent of the copyright owner, TEWA reserves the right to terminate this agreement

Other

    1. Feedback

    1.1 If you make a suggestion (or "feedback") to TEWA, you are deemed to have transferred all the rights of "feedback" to TEWA and agree that TEWA has the right to use this feedback and related information in any reasonable way. We will treat such feedback information as non-confidential and non-proprietary;

    1.2 You have agreed that you will not provide TEWA with any information that you consider confidential and proprietary;

    2. Privacy Policy

    2.1 Please refer to our "Privacy Policy", the "Privacy Policy" is an inseparable and equivalent part of this agreement.

    3. Disputes/Compulsory Arbitration

    This agreement is governed by the laws of the USA and interpreted under the laws of the USA. Any disputes arising from or related to this agreement shall be submitted to the related authority for arbitration, and the arbitration shall be conducted under the arbitration rules in effect at the time of application for arbitration. The final arbitration award is binding on both parties. You are deemed to have agreed to these terms by signing this agreement or using TEWA equipment or services.
